Federal Council approves amendment to Host State Ordinance

Bern, 15.08.2018 - At its meeting of 15 August 2018 the Federal Council approved the amendment to the Ordinance to the Federal Act on the Privileges, Immunities and Facilities and the Financial Subsidies granted by Switzerland as a Host State (Host State Ordinance, HSO; SR 192.121). The amendment is largely technical.

The Host State Ordinance approved on 7 December 2007 contains implementing provisions to the Federal Act on the Privileges, Immunities and Facilities and the Financial Subsidies granted by Switzerland as a Host State. The current amendment contains technical adjustments to ensure that the host state policy is designed more efficiently.

Under the Host State Act, the Federal Council is responsible for granting privileges, immunities and facilities to institutional beneficiaries, in principle subject to a negotiated agreement. To meet practical needs, in exceptional cases the Federal Council now also has the option to unilaterally decide to grant privileges, immunities and facilities to institutional beneficiaries.

In addition, a technical adjustment was made enabling the Federal Council to grant, in duly justified cases and in consultation with the institutional beneficiaries concerned, certain but not all privileges, immunities and facilities. This gives a formal legal imprimatur to the flexibility required by practical considerations.
