Déclaration du Conseil fédéral suite à la publication du rapport final de
l´Independent Committee of Eminent Persons (ICEP)

Le Conseil fédéral a pris note de la publication du rapport final de
l´Independent Committee of Eminent Persons (ICEP). Il tient à remercier les
membres de l´ICEP et tout particulièrement son Président, Paul A. Volcker,
pour le travail accompli.

Le rapport final de l´ICEP met un terme à une investigation rigoureuse et
exhaustive, sans précédent tant sur le plan suisse qu´à l´échelle
internationale, visant à identifier et restituer dans la mesure du possible
des avoirs déposés dans certaines institutions bancaires suisses par des
victimes des persécutions nazies. Le rapport conclut ainsi, en Suisse, un
volet essentiel du réexamen de la douloureuse et complexe question des
avoirs en déshérence datant de la Seconde Guerre mondiale.

Le Conseil fédéral prendra connaissance avec intérêt du contenu exact du
rapport. Il note d´ores et déjà que l´ICEP conclut que les banques suisses
n´ont mené aucune politique de discrimination à l´égard de leurs clients
d´origine juive ni procédé à des malversations systématiques au détriment de
victimes des persécutions nazies. D´autre part, le Conseil fédéral prend
note du manque de sensibilité et de l´attitude parfois peu coopérative à
l´égard des personnes à la recherche d´avoirs dormants au cours de
l´après-guerre que le rapport impute à certaines banques suisses. Cependant,
en coopérant à l´enquête et en en assumant entièrement les coûts, les
banques suisses ont témoigné de leur sincère volonté d´établir la vérité sur
l´existence et l´étendue en Suisse d´avoirs dormants datant de la Seconde
Guerre mondiale. En outre, l´association suisse des banquiers a adopté des
directives dans le but d´éviter que des avoirs puissent à l´avenir tomber en
déshérence et de faciliter la recherche de tels avoirs.

Dans ce contexte, le Conseil fédéral rappelle qu´un projet de loi fédérale
sur les avoirs en déshérence est actuellement en cours d´élaboration.

Declaration of the Federal Council upon the publication of the final report
of the Independent Committee of Eminent Persons (ICEP)

The Federal Council takes note of the publication of the final report of the
Independent Committee of Eminent Persons (ICEP). It would like to thank the
members of the ICEP and its Chairman Paul A. Volcker in particular for the
work they have carried out.

The final report of the ICEP marks the completion of a comprehensive and
thorough investigation, without precedent on both a Swiss and international
level, aimed at identifying and as far as possible returning the assets
deposited in certain Swiss banks by victims of Nazi persecution. The report
thus concludes an essential chapter in Switzerland in the reappraisal of the
painful and complex question of the dormant assets dating from World War II.

The Federal Council will examine the contents of the report in detail. It
already notes that the ICEP has concluded that the Swiss banks did not
follow any policy of discrimination regarding their clients of Jewish origin
or engage in any systematic misappropriation to the detriment of the victims
of Nazi persecution. On the other hand, the Federal Council notes the lack
of sensitivity and at times scantly co-operative attitude regarding people
searching for dormant assets during the post-war years that the report
attributes to certain Swiss banks. However, in co-operating with and
assuming the full costs of the investigation, the Swiss banks have testified
to their sincere determination to establish the truth regarding the
existence and extent of dormant assets in Switzerland dating from World War
II. Moreover, the Swiss Bankers Association has adopted a directive that
aims to prevent the possibility of assets becoming dormant in the future and
to facilitate the search for such assets.

Federal draft legislation on dormant assets is currently being prepared to
this end.
