Art. 1231 Criminal law
1 The Confederation shall be responsible for legislation in the field of criminal law and the law of criminal procedure.
2 The Cantons shall be responsible for the organisation of the courts, the administration of justice in criminal cases as well as for the execution of penalties and measures, unless the law provides otherwise.
3 The Confederation may issue regulations on the execution of penalties and measures. It may grant subsidies to the Cantons for:
- a.
- the construction of penal institutions;
- b.
- improvements in the execution of penalties and measures;
- c.
- institutions that conduct educative measures for the benefit of children, adolescents and young adults. 2
